Persons who contact the Panorama Feusisberg in any way, visit the hotel and/or the Akari Spa and access the Panorama Feusisberg website agree to the following terms and conditions of use as amended from time to time:
1.1 These contractual provisions govern the relationship between the customer and Panorama Feusisberg, including reservations on the website www.panoramaresort.ch and at the Akari Spa reception. They also apply to the sale of subscriptions.
1.2 All services provided by Panorama Feusisberg and the associated online reservations and other online services are subject to these General Terms and Conditions (GTC). Any deviating and/or supplementary agreements require the express consent of the management of Panorama Feusisberg and must be in writing; this also applies to any waiver of the written form requirement.
1.3 Users of the Panorama Feusisberg website confirm that they are familiar with electronic means of communication and are aware of the security risks associated with electronic traffic. Users undertake to make only lawful use of the means of communication.
1.4 The booking of a reservation is made on www.panoramaresort.ch by the customer. Panorama Feusisberg sends an electronic confirmation of the reservation to the customer. The contractual relationship comes into effect when the electronic confirmation is sent to the client.
1.5 The offers made by Panorama Feusisberg are subject to change and non-binding.
2. Customer data
Panorama Feusisberg is entitled to collect, store and process the customer's personal data required in the context of the business relationship, taking into account the corresponding duty of care in the sensitive handling of customer data:
3. Cancellation policy
Cancellations for booked treatment services, courses and workshops must be received by Panorama Feusisberg at least 24 hours before the appointment. If a cancellation is received less than 24 hours before the booked appointment, Panorama Feusisberg reserves the right to charge for the booked service. Instead of cancellation, the booked services can be used by a substitute person sent by the customer. Cancellations must be made by e-mail to firstname.lastname@example.org
Prices are quoted in Swiss francs (CHF). If payment is made in euros, the daily exchange rate applicable on the day of payment shall apply. Prices are inclusive of statutory value added tax. Prices are subject to change without notice.
5. Payment and means of payment
The amount for subscriptions (e.g. annual subscription) must be paid at the time the contract is concluded or when the contract is renewed. Panorama Feusisberg reserves the right to refuse access to the Akari Spa in the event of outstanding payments, to charge reminder fees and to take legal action.

5.2 Means of payment on site at the Akari Spa: Cash / Maestro / TWINT / Mastercard / Visa / Postcard / American Express / Diners Club International / JCB / V-Pay
6. Restricted offer
In the event of limited availability of the Akari Spa, the customer has no right to a refund or exchange. Furthermore, online sales of daily admissions, spa treatments and subscriptions may be discontinued at any time without further justification. In the event of limited use of the Akari Spa, subscription holders are subject to the terms and conditions of the annual subscription.
7. Limitation of liability
7.1 Liability regarding the use of the spa facilities:
Panorama Feusisberg accepts no liability whatsoever for material damage, personal injury or financial loss in connection with the operation of the wellness facilities. Use of the Panorama Feusisberg facilities is at the user's own risk. Panorama Feusisberg shall in particular not be liable for:
a) Damage caused by the use of swimming pools, saunas or other facilities of the Akari Spa
b) Indirect damage caused by third parties (theft, damage to property, injuries sustained while using the spa, etc.)
c) Loss of objects, money or other valuables.
This exclusion of liability does not apply if Panorama Feusisberg or its staff can be proven to have acted with intent or gross negligence.
7.2 Liability regarding participation in fitness lessons:
Panorama Feusisberg accepts no liability whatsoever in the event of concealment of any physical or mental ailments for which participation in fitness lessons is not advisable. Furthermore, the participant(s) shall not be liable to Panorama Feusisberg for any health or medical problems that may arise as a result of the fitness lessons. The client is therefore responsible for ensuring that he/she has sufficient insurance cover. Panorama Feusisberg reserves the right to refuse participants if the course management is of the opinion that the health or psychological requirements for participation in the fitness lesson are not met. This refusal can also be made at short notice or even during ongoing fitness lessons.
Changes and additions to these GTC by Panorama Feusisberg are permitted at any time. The version published online at the time of the electronic confirmation by Panorama Feusisberg shall apply.
9. Final provisions
The invalidity of individual points of these General Terms and Conditions of Business (GTC) shall not affect the validity of the remaining provisions. The invalid provision shall be replaced by a new provision which comes as close as possible in its economic effect to the invalid provision. The place of performance and jurisdiction for contracts, including these General Terms and Conditions (GTC), is the Wollerau District Court.
